Fonterra Anchor Milk Bottle Challenge - Terms and Conditions
Terms and Conditions How to Enter 1) By entering this competition, you accept these terms and conditions and agree to follow the instructions on how to enter. The Promoters ("we", "our", "us") may disqualify you from the competition if you do not comply with these terms and conditions. 2) This competition is open to New Zealand citizens and permanent residents aged 14 years or under. 3) You must obtain the consent of a parent or guardian to enter the competition, and that parent or guardian must sign the entry form. 4) The competition commences on 1st March 2009 and closes with last mail received on 30 April 2010 ("Competition Period"). 5) To enter, you must think up and create an invention or a cool way to re-use at least 1 Anchor milk bottle (any size). Entrants need to register their name and contact details online at http://younginventors.tv/2008/ a) drawings of your invention; or b) the URL of a YouTube video showing your invention. 6) You can enter as many times as you like. 7) We are not responsible for entries not received by us for any reason. 8) Incomplete, illegible, unclear or indecipherable entries may be deemed invalid by us, in our absolute discretion. 9) We reserve the right, at any time, to verify the validity of your details and entry (including your identity, age and place of residence) and to disqualify you if you submit an entry that is not in accordance with these terms and conditions. 10) If you are a prize winner, we will notify you or your parent/guardian by mail at the address provided on your entry form up to 6 weeks after you have been selected as a winner. Prizes 11) The judges, in their absolute discretion, will select a monthly winner for each month during the Competition Period from the entries received in the previous calendar month. Entries will be judged on the creativity and usefulness of the entrants' invention ideas. The 14 monthly winners will each receive an Apple iPod Touch 8G. The monthly prize draws will take place on the 30th of each calendar month at Television Spaceman Limited, 102 Newton Road, Newton, Auckland. 12) Entries for the first 10 months of the Competition Period (being entries from 1st March until 29th December 2009) will be eligible to be selected for additional prizes as set out below in clauses 15 to 21 of these terms and conditions. Entrants for the last three calendar months of the Competition Period will be ineligible for these additional prizes. 13) Prizes are not transferable, exchangeable or redeemable for cash. 14) The judges' decisions are final and no correspondence shall be entered into. Let's Get Inventin 2010 WINNER ALREADY CHOSEN, SEE DETAIL BELOW 15) Provided Let's Get Inventin' 2010 has been confirmed for filming, the judges will select a winner from the first 7 monthly winners (being the monthly winners for entries from 1st March 2009 until 29th October 2009). This winner will appear on an episode of the television show "Let's Get Inventin'" ("LGI Episode") to build their invention with the Let's Get Inventin' team ("Top Inventor Prize"). Entries will be judged on the creativity and usefulness of the entrants' invention ideas. The Top Inventor Prize winner will also receive: a) accommodation at a location of our choice in Auckland for the winner and one adult; b) return flights for the winner and one adult to Auckland in economy class, from the winner's closest regional airport (the winner is responsible for all costs associated with getting to their closest regional airport); c) airport transfers to and from the Auckland accommodation; d) travel costs between the television studio and the Auckland accommodation during filming. 16) The Top Inventor Prize winner and the adult accompanying the Top Inventor Prize winner to Auckland are responsible for paying all taxes and obtaining (at their own cost) insurance, or anything else necessary for them to benefit from the prize, including meals and all costs associated with getting to their local regional airport. The Top Inventor Prize winner must coordinate travel dates with us. Flights and accommodation are subject to availability. 17) The Top Inventor winner must have the permission of a parent/guardian to travel and appear on the LGI Episode, and must be accompanied by an adult. 18) On air and filming dates are yet to be confirmed for Let's Get Inventin' 2010. Winners will be notified and given fair notice of shoot and travel dates when these are established. Studio 2 19) The judges will select four winners from the first six monthly winners (being the monthly winners for entries from 1st March 2009 until 31st August 2009). The judges will select an additional winner from all entries from the Competition Period (being entries from 1st March 2009 until 30th March 2010). These winners will each appear on an episode of the television show "Studio 2" ("Studio 2 Episode") to show their designs with the Studio 2 team ("Studio 2 Prize"). Entries will be judged on the creativity and usefulness of the entrants' invention ideas. The Studio 2 Prize winners will also receive: a) accommodation at a location of our choice in Auckland for the winner and an accompanying adult; b) return flights for the winner and an accompanying adult to Auckland in economy class, from the winner's closest regional airport (the winners are responsible for all costs associated with getting to their closest regional airport); c) airport transfers to and from the Auckland accommodation; d) travel costs between the television studio and the Auckland accommodation during filming. 20) The Studio 2 Prize winners and their accompanying adults are responsible for paying all taxes and obtaining (at their own cost) insurance, or anything else necessary for them to benefit from the prize, including meals and all costs associated with getting to their local regional airport. Each Studio 2 Prize winner must coordinate travel dates with us. Flights and accommodation are subject to availability. 21) Each Studio 2 Prize winner must have the permission of a parent/guardian to travel and appear on the Studio 2 Episode, and must be accompanied by an adult. Participation Guidelines 22) All inventive ideas submitted must be original (i.e. you must not have used someone else's idea), and must have been invented by the participant named on the entry form. 23) When you submit any materials for this competition, including but not limited to drawings and videos ("Content"), you agree that: a) you will not submit any Content that is unlawful or fraudulent, or that the we deem is in breach of any intellectual property, privacy, publicity or other rights, or that we deem is defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; b) you will only submit Content that you have personally created; c) your Content will not depict or record injury or harm to any person or entity; d) if your Content depicts any person other than you, you have obtained their consent to submit the Content for the purposes of this competition; and e) you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. 24) Without limiting any other terms, you indemnify us for any breach of clause 23. 25) If you are the Top Inventor Prize winner selected to appear on the LGI Episode, you will make yourself and your invention available for the production of the LGI Episode at the times designated by us. Production of the LGI Episode will take place in Auckland 26) If you are a Studio 2 Prize winner selected to appear on a Studio 2 Episode, you will make yourself and your invention available for the production of the Studio 2 Episode at the times designated by us. Production of the Studio 2 Episode will take place in Auckland 27) If you are selected to be a Studio 2 Prize winner, the Top Inventor Prize winner or a monthly winner, you agree to participate in any publicity generated by us (or our marketing partners), and agree to the use of your name, city, photo and invention for promotional purposes without compensation. Rights in your invention 28) You agree that we are not obliged to use your invention on any Studio 2 Episode or LGI Episode. 29) Your invention may be valuable, and may be patentable or protectable under intellectual property laws. We are not responsible for patenting your invention and if you want to obtain such protection for it you should do so before entering this competition. If you have any concerns at all about intellectual property laws we recommend that you speak to a patent attorney. 30) We have a non-exclusive, royalty-free, transferable (without consent or notification), irrevocable, perpetual right to make a working prototype of your invention and to display your invention on a Studio 2 Episode, an LGI Episode, in public, on the Internet and in any other media for publicity purposes. Before a Studio 2 Episode or LGI Episode goes to air we will endeavour to maintain the secrecy of your invention, and we will have all mentors and judges involved with the Studio 2 Episode or LGI Episode sign confidentiality agreements with us. However, you acknowledge that neither we nor anyone else involved in the production or promotion of the Studio 2 Episode or LGI Episode shall be responsible to you for any failure to maintain such confidentiality, or for the loss of any protections or rights under any intellectual property laws arising as a result of such failure, the Studio 2 Episode, the LGI Episode, or any related publicity. 31) If we wish to publicise your invention before the Studio 2 Episode or LGI Episode goes to air we will contact you first to obtain your permission. General 32) It is a condition of entry that prize winners agree that to the extent permitted by law, neither we nor our retailers, suppliers, associated companies or agencies will be liable for any direct, indirect or consequential loss or damage whatsoever, including personal injury, which is suffered as a result of, or arising from, any person participating in this competition or in connection with winning a prize. 33) We reserve the right to modify these terms and conditions at any time, without notice. 34) We may retain your information to inform you about our products.
